General terms and conditions for using the atlascarbonneutral.com website and the services provided by Atlas Carbon Neutral Solutions S.r.l. — Benefit Corporation.
1. Acceptance of terms
These Terms of Service (hereinafter "Terms") govern access to and use of the atlascarbonneutral.com website and the services provided by Atlas Carbon Neutral Solutions S.r.l. — Benefit Corporation (hereinafter "Atlas").
Accessing the site and using the services — including free assessment funnels (CSRD Readiness, ESG Check, Energy Checkup, Mini Carbon Calculator) — constitutes full acceptance of these Terms. If the user does not accept the Terms, they must immediately cease using the site.
2. Scope of service
Atlas provides the following services through the website and digital platform:
- Free assessment funnels: online self-assessment tools for ESG, carbon footprint, energy efficiency and CSRD readiness. Results are indicative and do not replace professional analysis.
- ESG consulting services: materiality analysis, CSRD gap analysis, carbon footprint calculation, sustainability report preparation, regulatory compliance support.
- Digital platform: access to the client portal for ESG data management, KPI monitoring and report generation.
- Blockchain certification: anchoring of ESG data snapshots on the Base chain blockchain with SHA-256 hashing, to guarantee data integrity and verifiability over time.
- Blog and informational content: articles, guides and free resources on ESG, CSRD, carbon footprint and corporate sustainability topics.
Paid services are governed by specific individual contracts that supplement these Terms.
3. Registration and account
Access to certain platform features requires account creation. The user agrees to:
- Provide truthful, complete and up-to-date information
- Keep their access credentials confidential
- Promptly report any unauthorised use of their account
- Not transfer or share their account with third parties without Atlas's written authorisation
Atlas reserves the right to suspend or delete accounts that violate these Terms or that have been inactive for more than 24 months.
4. User obligations
The user agrees to:
- Use the site and services in compliance with the law and these Terms
- Not attempt to gain unauthorised access to Atlas's systems, networks or data
- Not use automated tools (bots, scrapers) to collect content or data from the site without authorisation
- Not upload unlawful, harmful content or content that infringes third-party rights
- Provide accurate and complete data when using the assessment funnels and platform services
The user is solely responsible for the data entered into the platform. Atlas processes the data provided without independently verifying its truthfulness or completeness.
5. Intellectual property
All content on the site — texts, graphics, logos, icons, images, software, calculation algorithms, data models and documentation — is the exclusive property of Atlas Carbon Neutral Solutions S.r.l. or its licensors and is protected by Italian and international copyright, trademark and industrial property laws.
Reproduction, distribution, modification or use of content without prior written authorisation from Atlas is prohibited, except for personal and non-commercial use.
Reports, calculations and certifications generated by the platform for the client are owned by the client with respect to input data and results. The calculation methodology, algorithms and underlying software remain the exclusive property of Atlas.
6. Data and confidentiality
Atlas treats client data with the utmost confidentiality. Data entered into the platform is used exclusively for the delivery of the requested services and is not shared with third parties for other purposes, except as required by law.

Atlas implements appropriate technical and organisational measures to protect data from unauthorised access, loss or destruction, in compliance with Article 32 of the GDPR.
7. Blockchain certification
Blockchain certification services involve the anchoring of cryptographic hashes (SHA-256) of the client's ESG data on the Base chain blockchain. This operation guarantees the integrity and immutability of the data snapshot at the time of certification.
It is important to understand that:
- Blockchain certification attests to data integrity at the time of anchoring, not to the original truthfulness of the data
- Atlas is not responsible for any errors in the input data provided by the client
- Blockchain transactions are irreversible by nature
- Public hash verification is accessible via the site's verification page (atlascarbonneutral.com/verify)
- Blockchain transaction costs (gas fees) are included in the service, unless otherwise agreed contractually
8. Limitation of liability
Atlas is committed to delivering services with professional diligence and in accordance with industry best practices. However:
- Informational content on the site and blog does not constitute professional advice (legal, tax, financial or environmental) and does not create any professional relationship
- Results from free assessment funnels are purely indicative and non-binding
- Atlas does not guarantee the absence of interruptions, errors or malfunctions in the service, though it undertakes to restore the service as soon as possible
- ESG and carbon footprint calculations are based on data provided by the client and on emission factors available at the time of processing; accuracy depends on the quality and completeness of input data
- Atlas is not liable for indirect or consequential damages, loss of profits or lost savings arising from the use or inability to use the service
Atlas's total liability to the client for any direct damage is limited, in all cases, to the total amount of fees paid by the client in the 12 months preceding the damaging event.
9. Disclaimer of warranties
The site and free services are provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
Atlas does not warrant that:
- The site will always be available, uninterrupted or error-free
- Results obtained through the services will be accurate or reliable for purposes other than those indicated
- The site is free from viruses or harmful components
For paid contractual services, specific warranties are governed by the relevant individual contracts.
10. Links to third-party sites
The site may contain links to third-party websites. These links are provided solely for the user's convenience. Atlas has no control over such sites and is not responsible for their content, privacy practices or terms of use.
The inclusion of a link does not imply endorsement, recommendation or affiliation by Atlas with the linked site.
11. Changes to service and terms
Atlas reserves the right to:
- Modify, suspend or discontinue any feature of the site or free service at any time without notice
- Update these Terms to reflect regulatory, organisational or technological changes
- Modify the pricing of paid services with at least 30 days' notice
Changes to these Terms will be communicated by updating the date at the top of this page. For contractual services, substantial changes will be communicated via email with reasonable notice.
Continued use of the site after publication of changes constitutes acceptance of the updated Terms.
12. Withdrawal and termination
The user may stop using the site and free services at any time, without notice.
For paid contractual services, withdrawal is governed by the specific terms of the individual contract.
Atlas may suspend or terminate the user's access to the site and services in the event of:
- Violation of these Terms
- Fraudulent or abusive use of the service
- Request by a judicial or other competent authority
Suspension or termination does not affect rights and obligations accrued prior thereto.
13. Governing law and jurisdiction
These Terms of Service are governed by Italian law.
For any dispute regarding the interpretation, performance or validity of these Terms, the parties agree to first attempt an amicable resolution. Failing agreement, the Court of Milan shall have exclusive jurisdiction.
For users who qualify as consumers under Italian Legislative Decree 206/2005 (Consumer Code), the mandatory provisions of applicable legislation shall apply, including the territorial jurisdiction of the court of the consumer's place of residence or domicile.
